Topic: Guardianship and Conservatorship

The recent documentary about the Free Britney movement captured a wide audience, interested them in her legal situation, and endeared her to many new fans. How and why can someone else control the life of another person under court supervision is a question much of the audience posed. With the rise in physical isolation and its impacts on people’s cognition, we have seen an increase in the number of older adults needing court appointed fiduciaries, known as a guardian and/or conservator and questions around how and when to appoint someone. In this conversation, we will discuss requirements for a court fiduciary, who may act as a fiduciary, what rises to the level of an emergency, and the steps and ongoing responsibilities of a guardian and conservator.
